Terms and Conditions (Accommodation Providers)

Agency Statement

Suncape Accommodations (SUNCAPE) acts in all cases as an agent and not as a principal in any agreement to rent accommodation. A contract will exist between the accommodation seeker (CLIENT) and the accommodation provider (PROVIDER).
The following terms and conditions may vary in the case of very special circumstances, e.g. organised tours or safari packages could have different payment terms. Please note that any variation is only valid if settled with SUNCAPE and highlighted on the web page describing the respective accommodation.

Listing your accommodation with SUNCAPE

Adding your accommodation is free of charge; however, SUNCAPE expects an industry standard commission of 10% for materialised business.

To add your accommodation(s) to the Suncape Accommodations Network, you will need to complete our online registration form.

Payment

All CLIENT payments will be received by SUNCAPE and then forwarded to the PROVIDER.

In practice: a CLIENT will request a booking. SUNCAPE will confirm availability and rates with you, the accommodation provider, who will inform SUNCAPE of the total amount due. Upon booking, the CLIENT will pay Suncape Accommodations cc a deposit, and the balance prior to check-in.

After having received the payment from the CLIENT, SUNCAPE will deduct its 10% commission and (where applicable) the credit card company's commission (ranging from 3.5% to 5%) or, alternatively, any bank remittance fees involved from the total amount and transfer the balance to the PROVIDER.

The PROVIDER will be paid in the following way:

Less than 45 days prior to arrival
or as soon as CLIENT pays
45% of full amount
(50% less 10% commission) (*)
Less than 14 days prior to arrivalRemaining 45% (*)

* Less Credit Card company's commission where applicable

Cancellation Terms & Charges

The following cancellation charges apply to CLIENTs booking your accommodation through SUNCAPE.

In case of a CLIENT cancelling a booking, SUNCAPE will deduct 10% from the amount due, with a minimum deduction of R50 being levied to cover administrational costs.
Please note that the PROVIDER may reduce or waive the cancellation charges if the PROVIDER succeeds in reselling (part of) the cancelled period.

Liability

SUNCAPE cannot be held liable for any errors or omissions contained within this site, or for damages, direct or consequential. The PROVIDER will be held fully responsible for the information listed. The PROVIDER should verify the listed information regularly.

The CLIENT and not SUNCAPE will be liable for damages caused to the PROVIDER.

Insurance

Adequate insurance cover is strongly recommended.

Jurisdiction

All agreements will be made in South Africa, Cape Town and be governed by South African law and be subject to the exclusive jurisdiction of the South African Courts of Cape Town.

Privacy

SUNCAPE will store and use the information supplied ("your information") for the purposes set out in our Privacy Policy (click here). You will be/would have been asked to agree to its use at the appropriate time. If you do not agree, SUNCAPE cannot accept your listing.

Changes to terms & conditions

SUNCAPE reserves the right to change its booking terms and conditions at any time. After a change, SUNCAPE will notify the PROVIDER via email. Any objections need to be transmitted via email or fax.
